This Criminal Miscellaneous Petition has been filed seeking to modify the order dated 18.08.2021 passed by this Court in Crl.O.P.No.14482 of 2021 from "Therefore, the petitioners are directed to surrender before the trial court within a period of two weeks from the date of receipt of a copy of this order or after commencement of normal functioning of the court, whichever is later and on such surrender, the learned Principal Sessions Court, Namakkal shall deal with the matter on the same day on merits and in accordance with law, after issuing notice to the victims under Section 15-A(3) of the SC/ST"

To "Therefore, the petitioners are directed to surrender before the Special Court for exclusive trial of SC & ST Cases within a period of two weeks from the date of receipt of a copy of this order or after commencement of normal functioning of the court, whichever is later and on such surrender, the learned Special Court for exclusive trial of SC & ST Cases shall deal with the matter on the same day on merits and in accordance with law, after issuing notice to the victims under Section 15-A(3) of the SC/ST"

2. Heard the submissions made by learned counsel appearing for petitioner and perused the records.

Considering the submissions and on perusal of materials, this Court is inclined to modify the order passed by this Court in Crl.O.P.No.14482 of 2021 dated 18.08.2021 in paragraph 2 as follows :- "Therefore, the petitioners are directed to surrender before the Special Court for exclusive trial of SC & ST Cases within a period of two weeks from the date of receipt of a copy of this order or after commencement of normal functioning of the court, whichever is later and on such surrender, the learned Special Court for exclusive trial of SC & ST Cases shall deal with the matter on the same day on merits and in accordance with law, after issuing notice to the victims under Section 15A(3) of the SC/ST" Accordingly, this Criminal Miscellaneous Petition is ordered.

4. Registry is directed to carry out necessary amendment in the order and issue fresh order copy.
