Respondent(s) PRAYER Transfer Civil Miscellaneous Petition filed under Section 24 of Code of Civil Procedure, prays to pass an order directing the withdrawal of EP No.6 of 2025 in RLTOP No.1 of 2020 from the file of the District Munsif Court, Nagapattinam, and transfer the same to District Munsfi Court, Thanjavur. ORDER

The petitioner seeks transfer of EP No.6 of 2025 in RLTOP No.1 of 2020, pending on the file of the District Munsif Court, Nagapattinam, to the file of the District Munsif Court, Thanjavur.

2. The learned counsel for the petitioner submitted that one of the decree holders is the 5th respondent, who is an Advocate by profession, is allegedly associated with rowdy elements and is facing two criminal cases registered against him. Owing to the said circumstances, no Advocate is willing to appear

on behalf of the petitioner, and therefore, he is constrained to appear as a partyin-person. Hence, the petitioner seeks transfer of the case to the file of the District Munsif Court, Thanjavur.

3. Considering the submissions made by the learned counsel for the petitioner, this Court finds the reasons stated to be justifiable and is inclined to allow the transfer.

4. Accordingly, EP No.6 of 2025 in RLTOP No.1 of 2020, pending on the file of the District Munsif Court, Nagapattinam, is withdrawn and transferred to the file of the District Munsif Court, Kumbakonam.

5. The District Munsif Court, Nagapattinam, is directed to transmit the case records to the District Munsif Court, Kumbakonam, within a period of three weeks from the date of receipt of a copy of this order.

6. Upon receipt of the records, the District Munsif Court, Kumbakonam, shall issue notice to all the respondents and thereafter proceed with the matter in accordance with law and dispose of the same as expeditiously as possible, preferably within a period of four weeks from the date of receipt of the case records. Till then, all further proceedings in EP No.6 of 2025 in RLTOP No.1 of

2020, pending on the file of the District Munsif Court, Nagapattinam, shall remain stayed.

7. Accordingly, this Transfer Civil Miscellaneous Petition is disposed of. Consequently, the connected miscellaneous petition is closed. No costs. 19-06-2026 Index:Yes/No Speaking/Non-speaking order Internet:Yes rri
