This is the Second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 19.06.2022 for the offences punishable under Sections 294(b), 417, 506(ii) IPC in Crime No. 12 of 2022 on the file of the respondent police.
2.The case of the prosecution is that, the petitioner aged about 50 years is already a married man and he is also a grandfather to his grand children and it is alleged that he had compelled and threatened the victim aged about 35 years and had physical intercourse with her, due to which, the victim became pregnant. Hence, the complaint.
3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.16337 of 2022, on 14.07.2022, considering the fact that the petitioner has committed very serious and heinous offence as against the victim.
4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
