Respondents Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the 2nd respondent proceedings made in Order No.V/42870/2011-1 dated 09.10.2013, to quash the same and consequently direct the respondents to extend all benefits of back wages and other dues, including pension and pensionary benefits thereto.

ORDER
The learned counsel appearing on behalf of the writ petitioner made a submission that the impugned order of termination was passed by invoking Rule 17(c)(i)(1) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules.
2. The writ petitioner was convicted by criminal Court of law and based on the judgment of conviction, the department had initiated action under Rule 17(c)(i)(1) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules and inflicted the punishment of dismissal from service. The petitioner preferred a criminal appeal against the order of conviction which is sub-judiced before the High Court. Therefore, the petitioner is at liberty to pursue his grievance after the dismissal of criminal appeal which is still pending.
3. Accordingly, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. 29.06.2022 mrm/psa Index: Yes/No Internet: Yes/No Speaking Order 2/4
