ORDER
The petitioner, who was arrested and remanded to judicial custody on 24.02.2026 for the alleged offences under Sections 294(b), 384, 297 and 506(ii) of IPC read with Section 3(1) of TNPPDL Act in Cr. No.3130 of 2021 on the file of the respondent police, seeks bail.
2. The petitioner is charged for the offences punishable under Sections 294(b), 384, 297 and 506(ii) of IPC read with Section 3(1) of TNPPDL Act and the case is pending in S.C. No.481 of 2025 on the file of the learned Additional District Sessions Judge No.IV, Ponneri. Since the accused failed to appear on 05.11.2025, NBW was issued against him and the petitioner was arrested on execution of non-bailable warrant and remanded to judicial custody on 24.02.2026.
3. The learned counsel for the petitioner would submit that this is a case of jumped bail and due to the non-appearance of the petitioner, non-bailable warrant was ordered to be issued on 05.11.2025. The learned counsel would further submit that the petitioner was arrested on execution of non-bailable warrant and he has been remanded to judicial custody on 24.02.2026 and he is ready to abide by any condition that may be imposed by this Court and hence prayed to enlarge the petitioner on bail.
4. The learned Government Advocate (Criminal side) appearing for the respondent police would submit that the earlier bail application was dismissed by this Court on 21.04.2026 and there is no change in circumstances and apart from that, this petitioner has 16 previous cases.
5. When this Court has put pertinent question as to the change in
circumstances, the learned counsel for the petitioner is not in a position to delineate the change in circumstances. Hence considering the above position, this Court is of the firm view that there are no grounds made out to deviate from the earlier circumstance.
6. Accordingly, this Criminal Original Petition is dismissed. 12-06-2026 MJS Note:
