Crime No.91 of 2026 ..Respondent Prayer: The criminal original petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, Act, 2023, to enlarge the petitioners on bail in the event of his arrest in connection with crime no. 91 of 2026 on the file of the respondent police and thus rendering justice. ORDER

The petitioners, who apprehending arrest at the hands of the respondent Police for the offences punishable under Sections 191(2), 296(b), 115(2) and 351(3) of BNS (Sections 147, 296(b), 323 and 506(ii) of IPC) r/w Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 1998 in Crime No.91 of 2026 on the file of the respondent Police, seeks anticipatory bail. 2.

The learned counsel for the petitioners, pleading innocence on the part of the petitioners and false implication in the case, seeks indulgence of this Court. He submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. He further submits that the petitioners are ready to abide by any stringent condition that may be imposed by this Court. Therefore he prayed to grant anticipatory bail to the petitioners.

3. The case of the prosecution, as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police while opposing the grant of anticipatory bail, is that the petitioners alleged to have criminally intimidated and physically attacked the de facto complainant.

4. Having heard the learned counsel for the petitioners, the learned Government Advocate (Crl.side) for the respondent Police and perused the materials available on record and this Court, taking into account that no injuries were sustained, is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate Court No.II, Madhuranthagam, Chengalpattu District on condition that the petitioners shall execute a bond for a sum of Rs.

[b] The petitioners 1, 3, 5, and 6 shall report before the respondent police daily at 10.30 a.m. until further orders, and petitioners 2 and 4 shall report as and when required for interrogation;

[c] the petitioners shall not tamper with evidence or witness either during investigation or trial;

[d] the petitioners shall not abscond either during

investigation or trial;

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
