This writ miscellaneous petition has been filed to modify the order dated 29.03.2023 passed by this Court in W.P.No.6961 of 2023.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.

3. Being satisfied with the reasons stated in the affidavit filed in support of this writ miscellaneous petition, paragraph No.7 of the order shall read as follows :

7. On perusal of the records, it is seen that there is a suo motu contempt petition in C.P.No.03 of 2021 pending before the APTEL. When the case is pending before the appropriate forum, this Court cannot interfere with the impugned letter issued by the first respondent. Hence, the prayer sought for by the petitioner cannot be granted as there is dispute pending between the parties. Hence, this Court is not inclined to interfere with the impugned letter. However, the encashment of the bank guarantee is subject to the result of the suo motu contempt petition which is pending before the APTEL.

3. Registry is directed to carry out the necessary correction in the order dated 29.03.2023 and issue a fresh copy of the order to the learned counsel for the parties.
