Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st respondent to sponsor the petitioner's name to the office of the 2nd respondent to consider for appointment to the post of Village Assistant in Pallipattu Taluk in Thiruvallur District, by considering the representation made on 24.06.2014. ORDER
The relief sought for in the present writ petition is to direct the 1st respondent to sponsor the name of the writ petitioner to the office of the 2nd respondent to consider him for appointment to the post of Village Assistant in Pallipattu Taluk in Thiruvallur District, by considering his representation dated 24.06.2014.
2. Mere submission of representation would not confer any right on the petitioner to issue a direction to sponsor his name for appointment to the post of Village Assistant. The names of eligible persons in accordance with the rules are to be sponsored strictly in accordance with the employment seniority and by following the rules of reservation. Many of the posts are now filled up only through open competition process. Therefore, the petitioner has to participate in the process of selection for securing appointment. However, the petitioner even at the time of the filing of the writ petition was aged about 43 years and now he would be around 51 years.
3. This being the factum, the relief sought for in the present writ petition is absolutely misconceived and accordingly, the Writ Petition stands dismissed. No costs. Sd/- Assistant Registrar (CS-VI) //True Copy// Sub Assistant Registrar jeni/hvk To
