Respondents Prayer: This Writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the Respondents to correct the date of birth as 12.03.1965 in the Service Records of the petitioner instead of 06.05.1963 on the basis of the letter sent by the Revenue Divisional Officer, Usilampatty, dated 23.12.1999 and 29.05.2000, within the period to be stipulated by this Hon'ble court and pass orders. ORDER

This writ petition is filed to seeking a direction to the Respondents to correct the date of birth as 12.03.1965 in the Service Records of the petitioner instead of 06.05.1963 on the basis of the letter sent by the Revenue Divisional Officer, Usilampatty, dated 23.12.1999 and 29.05.2000.

2. The case of the petitioner is that he was appointed as Junior Assistant in the office of The director, Agriculture Department, Chepauk, Chennai and in the service register of the petitioner the date of the birth was entered as 06.05.1963 based on his Educational Certificates, whereas his original date of birth is 12.03.1965. To correct the same, the petitioner has applied and obtained new birth certificate which reveals the correct date of birth of the petitioner. The petitioner has also produced the same to his higher officials and gave several representations to correct the date of birth, but the same was not considered. Hence this petition.

3.Today when the matter is taken up for hearing the learned counsel for the petitioner submits the petitioner died and nothing survives in this petition for further adjudication and he has also made an endorsement to that effect.

4. Recording the submission made by the learned counsel for the petitioner, this Writ Petition is dismissed as abated. No costs. 17.03.2023 Speaking order : Yes/No Index : Yes/No smn To
