ORDER

This revision has been preferred challenging the docket order on the file of the XVII Assistant Judge, City Civil Court, Chennai, in I.A.No.3 of 2025 in O.S.No.2889 of 2025 dated 22.05.2025. 2.The learned counsel for the petitioner contended that in flagrant violation of the bye-laws of the Association of God of India (AGI), the elections are now proposed to be held between 10.06.2025 and 12.06.2025. However, I find that the notification which is claimed to be the election notification was issued as early as on March 2025. However, the suit has been filed only in May 2025 and the City Civil Court has ordered notice on the application. The petitioner also moved a Civil Miscellaneous Appeal challenging the said order of notice. However, the appeal was rejected as not maintainable and thereafter, the present revision has been filed. 3.Though the learned counsel for the petitioner points out several deficiencies in the said election notification, all these issues cannot be gone 2/4

into in a revision. Admittedly, all factual matters have to be dealt with by the Court of the first instance where I.A.No.3 of 2025 is pending in O.S.No.2889 of 2025. However, at the same time, in order to protect the interest of the revision petitioner, in view of the apprehension raise, the following order is passed.

(i) The XVII Assistant Judge, City Civil Court, Chennai, is directed to hear I.A.No.3 of 2025 on merits and pass orders within a period of 30 days from the date of receipt of a copy of this order. (ii) In the event of there being any nomination/election in the ensuing conference to be held between June 10 and June 12 of 2025, the final decisions/results shall not be given effect to and shall be kept in abeyance till I.A.3 of 2025 is finally disposed of, as indicated above. 4.With the above directions, the Civil Revision Petition is disposed of. There shall be no order as to costs. Connected Civil Miscellaneous Petition is closed.
