O R D E R

The present writ petition is filed praying for a writ of mandamus to direct second respondent to issue patta in the name of petitioner based on the application dated 07.01.2024 submitted by her.

2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The case of petitioner is that the land comprised in Survey No.52 at Kattukottai Lakshminadhapuram, Korakavadi Post, Thittakudi Taluk, Cuddalore District originally belongs to petitioner and she is the absolute owner of the subject property. The petitioner is in continuous possession and enjoyment of the subject property and petitioner has also paid appropriate revenue taxes to the Panchayat and other Revenue Authorities. The grievance of petitioner is that till date the

patta has not been issued in her name. Hence, petitioner submitted an application on 07.01.2024 seeking to issue patta in favour of her. Since the same was not considered, the present writ petition has been filed. 4.

Learned Special Government Pleader appearing for respondents, on the other hand, would submit that the land in question have been classified as quarry land and thus, petitioner may not have any right to claim patta in her name. In any view, learned Special Government Pleader would further submit that the concerned respondent would conduct an enquiry after affording opportunity to petitioner and any other interested party and the application would be considered and orders will be passed within the time frame to be fixed by this Court

5. In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to second respondent to consider the application submitted by petitioner on 07.01.2024 seeking issuance of patta

in respect of subject property and conduct enquiry by issuing notice to petitioner and interested parties, if any and affording an opportunity of hearing to petitioner and any other interested parties and the orders shall be passed on its own merits within a period of twelve weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to second respondent to consider the case on its own merits and in accordance with law.
