PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records on the file of 3rd respondent pertaining to the notice bearing reference No.550/09/A2 dated 17.06.2014 and quash the same.

O R D E R

The order impugned is the notice dated 17.06.2014, which states that the petitioner was a defaulter in payment of rent and in the event of not paying the rent, eviction proceedings will be initiated.

2. This Court passed an interim order, directing the petitioner to pay the monthly rent continuously.

3. The learned counsel for the petitioner also states that soon after the interim order, the rent was paid by the petitioner. However, the period of lease already expired as per the petitioner. If the period of lease expired and if there is no extension of lease, then the respondents are bound to initiate action. However, if the period of lease is extended, then the petitioner is liable to pay the rent continuously as agreed between the parties.

4. With these observations, the writ petition stands disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
