This Criminal Original Petition has been filed seeking to modify the bail condition in Crl.M.P.No.581 of 2018 dated 17.05.2018 on the file of Sessions Judge, Special Court for Exclusive Trial of Cases registered under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, Villupuram enabling the petitioners 1 and 2 to appear before the Sessions Judge, Special Court for Exclusive Trial of Cases registered under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, Villupuram instead of appearing before the Inspector of Police, Perambalur Police
Station, Perambalur District.
2. Heard both sides. Perused the materials available on record.
3. The learned Sessions Judge, Special Court for Exclusive Trial of Cases registered under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, Villupuram has granted bail to the petitioners on condition that the petitioners 1 and 2 shall appear before the Perambalur Police Station daily at 10.30 A.M. and 5.30 P.M. and the third petitioner was directed to sign before the respondent police daily at 10.30 a.m. until further orders. Now, the petitioners seek modification of the said condition to the effect that the the petitioners may be directed to appear before the Special Court (SC & ST Cases)
4. The learned counsel appearing for the petitioners would submit that they are only farmers and the first petitioner is 70 years old and also physically handicapped and prays for modification of the condition.
5. Considering the facts and circumstances of the case and also considering the submissions made, the condition imposed by the learned Sessions Judge, Special Court for Exclusive Trial of Cases registered under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, Villupuram on 17.05.2018 is modified to the effect that the petitioners shall appear before the learned Sessions Judge, Special Court for Exclusive Trial of Cases registered under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, Villupuram daily at 10.30 A.M. until further orders.
