... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.T.S.Arthanareeswaran, the learned counsel for the Appellant/claimant and Mr.Rajadurai, the learned counsel for the 3rd respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

COMMON TERMS OF SETTLEMENT The appellant Syedmubarak filed MCOP No.624 of 2022 before the Motor Accident Claims Tribunal/Special District Judge, Salem claiming compensation of Rs.15,00,000/- with interest and costs. The trial Court awarded a sum of Rs.2,20,000/- and the said amount was already deposited by the third respondent/insurance company. Aggrieved by the award passed by the Tribunal, the petitioner Syedmubarak filed the present appeal before the Hon'ble High Court. 2.Both the parties have initiated negotiation and have successfully arrived at a settlement of all the issues arising in this case as follows; the third respondent insurance company limited has now agreed to pay a sum of Rs.1,75,000/- in addition to the a sum of Rs.2,20,000/- already awarded by the trial Court, in full quit, within a period of four weeks from the date of receipt of a copy of this order.

3.Both the parties made a request to the Lok Adalat to pass an award in terms of the about settlement.

4.As a result, the award is passed thereof in terms of the above compromise arrived at between the parties directing the third respondent Insurance Company to pay an additional sum of Rs.1,75,000/- over and above the amount of Rs.2,20,000/- already paid in terms of the award passed by the trial Court within a period of four weeks from the date of receipt of the order passed by the Lok Adalat. The appellant is entitled to withdraw the entire amount awarded by the Tribunal as well as by this Court in terms of the compromise recorded by the Lok Adalat.
