Prayer:- The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the third respondent to declare the result of the interview conducted on 17.02.2012 and issue appointment order to the petitioner.

According to the petitioner, Thiruvallur District employment office sponsored candidates to the Revenue department for selection to the post of Village Assistants wherein the petitioner also one of the candidates and he also participated in the interview conducted by the respondent. Though the interview process has been completed in the year 2012 by the third respondent, the results were not declared. The representation made by the petitioner does not evoke any response. Therefore, the petitioner has preferred the present writ petition before this Court seeking direction to declare results.
2. The third respondent has filed counter affidavit wherein it is stated that District Employment office, Thiruvallur sponsored candidates for selection to the post of Village Assistants. Pursuant to the interim orders passed by this Court in W.P.No.1588 of 2012 dated 25.1.2012 and 3.12.2012, after getting opinion from the Government Pleader, the second respondent issued appointment orders to six persons with effect from 17.2.2012 who were covered under the aforesaid writ petition. However, the said appointment was also cancelled by the second respondent by order, dated 9.1.2012. Hence, revised list of eligible candidates for the remaining vacant posts of seven Village Assistants were called for from the District Employment office, Tiruvallur by the third respondent in Rc.No.9203/2011/ A3 dated 17.12.2012.
It is ascertained from the connected file relates to appointment of Village Assistants being maintained by Taluk office, Tiruttani that no list was received from the District Employment office, Tiruvallur in response to the letter sent by the third respondent on 17.2.2012. In the meantime, the third respondent has reported to the first respondent by letter, dated 27.6.2012 that sixty five incumbents have been working in sixty five revenue villages in Tiruttani Taluk, as such no post of Village Assistant has been left vacant. Therefore, there is no possibility of considering any of the persons who were called on to attend enquiry on 17.2.2012 including the petitioner for appointment to the post of Village Assistant due to want of vacancies for the said post.
3. In view of the stand taken by the third respondent in the counter affidavit filed before this Court as there is no vacancies for the post of Village Assistant, the relief as sought for by the petitioner cannot be granted and consequently, the writ petition is liable to be dismissed.
