This Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus forbearing the respondents 1 to 3 from constructing any building in the vacant land comprised survey No. 335/2 situate at Thottiypampatti Village, Vennandhur Panchayat Union, Rasipuram Taluk, Namakkal District under the MGNEGS Scheme 2017- 2018 based on the representations of petitioner dated 21.05.2020 and 31.07.2020.

ORDER

This Writ Petition has been filed by one of the ward member of a Village Panchayat. The grievance of the petitioner is that attempts are made by the respondents to construct a building in a property, which has been categorised as a 'grazing ground' inspite of the protest made my the local people. https://hcservices.ecourts.gov.in/hcservices/

In the considered view of this Court, the nature of grievance expressed by the petitioner is more in the nature of Public Interest Litigation and this Court cannot enquire and assess as to how a poramboke land must be put to use by the authorities. If the petitioner feels that it will affect the public interest, then the petitioner will have to file a Public Interest Litigation and ventilate the grievance. This Court is not inclined to entertain this Writ Petition and accordingly, this Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
