C.M.P.No.12636 of 2022 in C.R.P.SR.No.79585 of 2022 C.M.P.No.12636 of 2022 in C.R.P.SR.No.79585 of 2022 R.N.MANJULA , J.

This petition has been filed to accept the cause title for including the legal representatives of the deceased Pownammal in the above Civil Revision Petition.

2.

The revision petitioners are the legal representatives of one Pownammal, who was the defendant in the suit; the suit was filed by the plaintiffs for the reliefs of declaration and permanent injunction; the suit was decreed ex parte on 11.07.2003; the defendant in the said suit namely Pownammal had filed a petition in I.A.No.49 of 2015 in O.S.No.22 of 1999 to condone the delay of 3760 days to set aside the ex parte judgment dated 11.07.2003 and the said petition was dismissed on 21.11.2020. Now, the learned counsel for the revision petitioners submitted that the said petitioner Pownammal died on 23.01.2022. Since Pownammal died, her legal representatives alone can file the Civil Revision Petition. Hence, the cause title showing the names of the legal representatives of the deceased Pownammal should be accepted.

3.

In view of the same, this petition stands allowed. 16.08.2022 Note: Registry is directed to number the Civil Revision Petition, if it is otherwise in order.
