This Criminal Original Petition has been filed by the petitioners/A2 & A3, who were arrested and remanded to judicial custody on 10.05.2024, seeking bail in Crime No.177 of 2024 registered for the offence under Sections 273, 328 of IPC r/w Sections 7, 21(1) of Cigarettes and other Tobacco Products Act, 2003 and Sections 58, 59 of Food Safety and Standards Act, 2006.

2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners have been suffering incarceration from 10.05.2024 and they are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioners.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that the petitioners/A2 and A3 along with A1 had illegally transported 900 kilograms of banned tobacco products in their vehicle. He further submitted that the case is under investigation and there is no previous case against these petitioners, however, if they are released on bail, there is every possibility of them absconding and not available for further investigation. https://www.mhc.tn.gov.in/judis

4. Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) that the investigation is at initial stage and considering the quantity of banned tobacco products transported by the accused, this Court is not inclined to grant bail to the petitioners.
