Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari calling for the records of the second respondent in Na.Ka.3501/2011/A1, dated 09.09.2014 and quash the said proceedings as being violative of principles of natural justice, arbitrary and untenable in law. The petitioners have filed this writ petition seeking issuance of Writ of Certiorari calling for the records of the second respondent in Na.Ka.3501/2011/A1, dated 09.09.2014 and to quash the said proceedings as being violative of principles of natural justice, arbitrary and untenable in law. 2.The learned Senior Counsel appearing for the petitioners submitted that the impugned order has been passed by the second respondent restraining the petitioners to cut or sell the trees in the disputed lands on the ground that dispute is pending with the revenue Officials. The learned Senior Counsel further submitted that after lapse of several years, the casuarina trees in the disputed lands would have lost its character. Hence, this Court may permit the petitioners to canvass all the points before the revenue Officials with regard to patta and other revenue records.
3.Recording the submission made by the learned Senior Counsel appearing for the petitioners, this writ petition stands disposed of with liberty to the petitioners to work out the remedy in the manner known to law. The pending proceedings may be concluded within a period of six months from the date of receipt of a copy of this order, after providing opportunity to the petitioners.
No costs. Consequently, the connected miscellaneous petition is closed.
