This petition has been filed seeking to condone the delay of 344 days in filing the appeal.

2. Heard the learned counsel for the petitioner.

3. Despite the receipt of notice, on behalf of the third respondent, none represented.

4. The petitioner would aver that due to financial inability and health problem, the delay of 344 days occurred, which is not wanton.

5. The reasons assigned by the petitioner in the affidavit appear to be reasonable and acceptable. Therefore, this Court is inclined to allow this petition, subject to the condition that the interest for the delay period of 344 days shall stand waived.
