Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents herein to cancel the patta issued in favour of respondents 5 and 6 and to issue patta and chitta in the name of petitioners in respect of lands measuring an extent of 3.46 acres in Survey No.102, 0.96 acres in Survey No.101/3 and 1.88 acres in Survey No.101/2 situate at Kamandoddi Village, Hosur Taluk, Krishnagiri District based on the representation dated 30.05.2013 within the time to be stipulated by this Court.

ORDER

The petitioners seek for a direction to the respondents 1 to 4 to cancel the patta issued in favour of respondents 5 and 6 and to issue patta and chitta in the name of petitioners in respect of lands measuring an extent of 3.46 acres in Survey No.102, 0.96 acres in Survey No.101/3 and 1.88 acres in Survey No.101/2 situate at Kamandoddi Village, Hosur Taluk, Krishnagiri District based on their representation dated 30.05.2013.

2. The petitioners are aggrieved by the grant of patta in favour of Respondents 5 and 6. In this regard, the petitioners have sent a representation to the first respondent and since no action was taken by the first respondent, the petitioners have filed the present writ petition.

3. In the light of the above, without going into the merits of the contention raised by the petitioners, there will be direction to the first respondent to consider the petitioners' representation dated 30.05.2013 after issuing notice to 5th and 6th respondents and after hearing the parties and shall pass a speaking order on merits and in accordance with law. The above said direction shall be complied with within a period of three months from the date of receipt of a copy of this order.

4. The writ petition is disposed of with the above direction. No costs.
