ORDER

By this petition, the petitioner seeks the consideration of representation dated 15.05.2025 in relation to Trade Mark Application No.6586357.

2. The petitioner submitted the above mentioned application for registration of the device mark "SKYLON INDIA" "SHAPING YOUR DREAM SPACE" on 22.08.2024. Since the petitioner did not receive an examination report till date, the present writ petition was filed.

3. Learned counsel for the respondent submits that all applications are being examined as per order of receipt and that there is a huge backlog. He also submits that there is a procedure for expedited processing of the application and that the petitioner cannot be permitted to jump the queue. 2/5

4. The application was filed almost one year ago. In these circumstances, it is just and appropriate that the petitioner's application be processed within a reasonable time. Considering the date of filing of the application, even after taking into account the backlog, a period of three months would be reasonable.

5. Accordingly, W.P.(IPD)/29/2025 is disposed of by directing the Registrar of Trade Marks to either issue the examination report or accept the application for advertisement in Trade Mark Application No.6586358 within three months from the date of receipt of a copy of this order.
