Petition filed under Article 226 of the Constitution of India for the issuance of writ of Certiorarified Mandamus, calling for the records relating to the order of the respondent dated 08.07.2006 in Na.Ka.No.757/2006/A and quash the same and consequently direct the respondent to forthwith reinstate the petitioner in service as Salesman in the TASMAC Wine Shop. O R D E R

The petitioner was appointed as Salesman in Tamil Nadu State Marketing Corporation Limited (hereinafter referred to as TASMAC). He was employed at Shop No.151, Teppakulam Street at Pollachi Taluk, Coimbatore District. The petitioner worked for more than five years.

2. While so, he was suspended on 08.07.2006 alleging certain discrepancies found on inspection by the concerned officials on 07.07.2006. It is the grievance of the petitioner that further proceedings were not taken by the respondent. The petitioner therefore challenges the suspension order on the ground that it was continuous suspension without reviewing the matter.

3. The learned Standing Counsel for TASMAC on instructions submitted that the respondent would consider the representation submitted by the petitioner on 11.06.2008 on merits.

4. The respondent is directed to consider and dispose of the https://hcservices.ecourts.gov.in/hcservices/

representation submitted by the petitioner dated 11.6.2008 on merits and as per law. Such exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.

5. The petitioner is directed to forward a copy of the representation dated 11.06.2018 along with a copy of this order so as to enable the respondent to consider the matter as expeditiously as possible.

6. The writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
