C.M.P.No.26219 of 2023 in S.A.SR.No.80075 of 2022 P.T.ASHA, J., Today an affidavit of service has been filed in and by which it is seen that the private notice which has been sent to both the respondents has been returned unclaimed and it is also noticed that intimation has been delivered to them on two dates. Therefore, there is a deemed service on the respondents.

2. The above petition is filed to condone the delay of 87 days in filing the above Appeal.

3. Heard the learned counsel for the petitioners/appellants.

4. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 87 days in filing the above Appeal is condoned.

5. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
