C.M.P.No.14371 of 2024 in C.M.A. No.1450 of 2024 R. HEMALATHA.J., The present petition is for filing additional documents viz., driving licence and R.C.Book of the vehicle bearing registration No. TN 01 T 5683. The Tribunal in its order dated 09.12.2019 directed the Insurance Company to pay the award amount at the first instance and then recover the same from the owner of the vehicle since the driver of the offending vehicle did not have a valid driving licence on the date of the accident. The present appeal in C.M.A.No.1450 of 2024 is filed by the owner of the vehicle challenging the same.
2. The claimants did not raise any objection for allowing this petition. However, the Reliance General Insurance Company Ltd., filed a counter stating that since the owner of the vehicle did not have a valid driving licence on the date of the accident, the Tribunal was right in directing the Insurance Company to pay the amount in the first instance and then, recover 1/2 https://www.mhc.tn.gov.in/judis
R. HEMALATHA.J., ab the same from the owner of the vehicle. Since the driving licence and R.C. book have been filed now, the same can be received as additional documents subject to proof accuracy. C.M.P.No.14371 of 2024 in C.M.A.No.1450 of 2024 is allowed.
3. Registry is directed to list the C.M.A.No.1450 of 2024 for final hearing after two weeks.
