This application has been taken out by the defendant in the suit seeking permission to produce certain documents to demonstrate the rental income in the vicinity of the suit property. The only relief that survives in the suit is the relief of mense profits.

2.Mr.Mukunthan, learned counsel for the respondents / plaintiffs in the suit would submit that the documents can be received subject to proof and relevancy.

3.In view of the submission made by the learned counsel for the respondents and considering the reasons assigned in the affidavit filed in support of the application for the delay in production of the documents, this application is allowed, the documents are permitted to be produced, subject to proof and relevancy.
