Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 5th and 6th respondents to consider petitioner's
representation dated 09.11.2020 and issue new patta in respect of property measuring about 3 1⁄2 cents in S.No.405/2 in Thanigaipolur, Arakkonam Taluk, Ranipet District, so as to enable them to eligible to avail benefit under ''Pradhan Mantri Awas Yojana (PMAY), Housing for All (Urban & Rural) Mission'. ORDER
The present petition is filed by the petitioner seeking a direction to the 5th and 6th respondents to consider the petitioner's representation dated 09.11.2020 and issue a new patta in respect of property measuring about 3 1⁄2 cents in S.No.405/2 in Thanigaipolur, Arakkonam Taluk, Ranipet District, so as to enable them to avail benefit under ''Pradhan Mantri Awas Yojana (PMAY), Housing for All (Urban & Rural) Mission'. 2.The petitioner has approached the authorities by his representation dated 09.11.2020 seeking for issuance of new patta.
3.Heard both sides.
4.Mr.E.Balamurugan, learned Special Government Pleader takes notice on behalf of the respondents 3 to 6 and made a statement on instructions, that an enquiry is fixed at 11.00 a.m., on 08.02.2021at the Office of the sixth respondent/Tahsildar, for ascertaining feasibility of assigning new patta to the petitioner.
5. The said statement of the learned Special Government Pleader is recorded.
6.In view of the said statement, the enquiry officer/sixth respondent is required to dispose of the petitioner's representation dated 09.11.2020 through a speaking order within a period of eight(8) weeks from the date of receipt of a copy of this order.
