The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Section 420 of IPC in Crime No.Not known of 2023 on the file of the respondent police, seek anticipatory bail.

2. Apprehending arrest on the complaint given by one Bayas Wilson, the petition is filed by the petitioners seeking anticipatory bail.

3. It is contended by the petitioners that a sale agreement between them and the de-facto complainant has been given criminal colour by the de-facto complainant by using police force.

4. The learned Government Advocate (Crl.side) for the respondent states that there is a money dispute between the de-facto complainant and the petitioners and therefore, a petition given by the de-facto complainant been taken up in complaint petition No.343/DCB/NGT/2023 and the petitioners were summoned for enquiry, but they have not cooperated. 1/2 https://www.mhc.tn.gov.in/judis

5. The learned counsel appearing for the petitioners states that they have not received any summons and if they are summoned for enquiry, they are ready to appear and cooperate for the enquiry.

6. This Court, on considering the rival submissions, dispose of this Criminal Original Petition with a direction to the petitioners to appear before the Investigating Officer on receipt of summons and co-operate with the investigation. Unless and until there is any cognizable offence is made out, the petitioners shall not be arrested.
