The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 4(1)(aaa), 4(1A)(ii) of TNP Act and Section 6 and 7 of Tamil Nadu Rectified Sprit Rules, 2000 in Crime No.288 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. Learned counsel for the petitioner submitted that, petitioner is falsely implicated in this case in Crime No.288 of 2023 for the offences under Sections 4(1)(aaa), 4(1-A)(ii) of TNP Act and Section 6 and 7 of Tamil Nadu Rectified Sprit Rules, 2000, on the basis of confessional statement of the co-accused. Petitioner is innocent. Apprehending arrest at the hands of the respondent police, this petition is filed.
3. Learned Government Advocate (Criminal side), opposes on the ground that, this case involves illegal possession of 4375 litres of rectified sprit. There are 14 accused in this case and petitioner is the 14th
accused. He has three similar cases pending against him. Thus, he prays for dismissal of this petition.
4. In the light of the submissions of the learned counsel Government Advocate (Criminal side) and the fact that, petitioner has three previous cases pending against him, this Court is not inclined to grant anticipatory bail to the petitioner.
5. Accordingly, this Criminal Original Petition is dismissed. 13.07.2023 gd
