The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(4) of the Tamil Nadu Schedule Commodities (RDCS) Order 1982, Section 7(1)(a)(ii) of Essential Commodities Act 1955 in Crime No,.138 of 2023, seek anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found to be in illegal transportation of 1150 Kgs of PDS rice worth about Rs.37,950/-. Hence, the complaint.

3. The learned counsel for the petitioner submitted that this is the second application for anticipatory bail. Earlier application for anticipatory bail was dismissed on 20.06.2023 in Crl.O.P.No.13327 of 2023, on the ground that the petitioner has got seven previous cases pending against him. He would further submit that petitioner is ready to abide by any stringent conditions that may be imposed by this Court and hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the petitioner along with other accused were found to be in illegal transportation of 1150 Kgs of PDS rice worth about Rs.37,950/-. He would further submit that this Court on earlier occasion granted bail to the other co-accused in this case, as there was no previous case pending against them and as far as this petitioner is concerned, there are seven previous cases in similar nature pending against him, hence, this Court dismissed the bail application. He would also submit that there is no change of circumstances. Hence, vehemently opposed for grant of anticipatory bail to the petitioner.

5. Heard the learned counsel on either sides and perused the entire materials available on record including contents the First Information Report.

Taking into consideration the facts and circumstances of the case, the submission made by the learned counsel on either sides, the petitioner has seven previous case pending against him and there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition for anticipatory bail stands dismissed.
