Writ Petition filed Under Article 226 of the Constitution of India, to issue a writ of Mandamus directing the third respondent to take appropriate action based on the complaints of the petitioner as directed by the first respondent Government in their letters No:82415/POL.19/2014-1 dated 23.01.2015 and in letter No:34941/POL.19/2015- 1 dated 10.06.2015. The relief sought for in the present Writ Petition is to direct the third respondent to take appropriate action based on the complaints of the petitioner as directed by the first respondent/Government in their letter No.82415 / POL.19 / 2014-1 dated 23.01.2015 and also in their letter No. 34941 /POL.19/2015 -1 dated 10.6.2015.
2. The counter filed the respondent would reveal that the petitioner preferred a complaint before the Government/first https://hcservices.ecourts.gov.in/hcservices/
respondent and the same was forwarded to the third respondent and the third respondent in turn forwarded the complaint to the Superintendent of Police, Economic Offences Wing, Chennai, and finally the Inspector of Police was directed to conduct an enquiry. The Inspector of Police, EOW - II, Trichy, enquired Mr.Palaniammal/petitioner's complaint and came to the conclusion that the complaint has not discloses any EOW offences, and also the Inspector EOW Trichy has obtained opinion from Madurai, Special Public Prosecutor, TNPID. The Special Public Prosecutor clearly stated in his opinion that Section 5 of the TNPID (F&E) Act 1997 will not attracted. On the basis of the opinion the Inspector of Police EOW-II, Trichy has not registered any case as against the complaint given by the Palaniammal/Petitioner herein. Accordingly, the final report was forwarded to the Superintendent of Police, EOW-II, Chennai. The said factum was also informed to the petitioner. Thus, the petitioner is at liberty to approach the Competent Forum for redressing her grievances in the manner known to law.
3. With these observations, the writ petition stands disposed of. No costs.
