Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to reinstate the petitioner in service by revoking order of suspension dated 09.01.2018 based on the representation dated 20.02.2020 and 09.02.2021.

ORDER

Ms.Djearany, learned Government Advocate (Pondicherry) takes notice on behalf of the first respondent.

2. The petitioner was placed under suspension by an order dated 09.01.2018 and thereafter the second respondent has also been issued with a Show Cause Notice dated 28.06.2018. The petitioner replied to the same on 09.07.2018. Despite the reply, the respondents have not completed the disciplinary proceedings. Under these circumstances, the petitioner appears to have sent two representations to the second respondent on 20.02.2020 and on 09.02.2021 with a request to recall the suspension order and to reinstate the petitioner into service.

3. It is the case of the petitioner that the petitioner is aged about 57 years and will retire in another 2 1⁄2 years time and therefore the petitioner may be reinstated into service.

4. Considering the fact that the petitioner has already been issued with a Show Cause Notice and the petitioner has also replied to the same, this Writ Petition is disposed at the time of admission by directing the second respondent to complete the disciplinary proceedings initiated in the Show Cause Notice dated 28.06.2018, within a period of six months from the date of receipt of a copy of this order.

5. It is made clear that during the pendency of the disciplinary proceedings, the petitioner shall be paid subsistence allowances as per the relevant rules applicable to the second respondent and the petitioner.

6. This Writ Petition stands disposed of with the above observations. No costs.
