This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus quash the impugned order dated 20.01.2024 in REV-114 Legal Heir Certificate passed by the third respondent, directing the third respondent to issue the legal heir certificate in the name of the petitioner.

2.The learned counsel appearing for the petitioner submitted that the petitioner's husband died and the petitioner is his only surviving legal heir and she made application for legal heir certificate and the same was rejected by the respondents without conducting any verification, which is not sustainable one. The learned counsel further submitted that the petitioner's husband's parents died, however, the respondents have made remark in the impugned order to include their name and to re-send the application. 3.The learned Additional Advocate General appearing for the 2/4

respondents submitted that there is a format for applying for legal heir certificate. The petitioner has to apply through online by indicating the name of the parents of the deceased even though they have passed away and the name of the legal heirs of the deceased. He further submitted that if the petitioner apply for legal heir certificate in the prescribed format through online, her application will be considered in the manner known to law.

4.Considering the submissions made on either side, this Court, directs the petitioner to apply for legal heir certificate in the prescribed format through online, within a period of two weeks from the date of receipt of a copy of this order. If any such application is made by the petitioner, the respondents are directed to consider the same and to pass appropriate orders within a period of four weeks thereafter.

5.The writ petition is accordingly disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 05.09.2024 pri Index: Yes/ No 3/4
