O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondent to pay interest at 10% for the belated 1/4

payment of terminal benefits such as Gratuity, Provident Fund, Leave Salary and unpaid last retired month salary of 11 days to the petitioners.

The learned counsel for the petitioner would submit that the petitioner sent a representation claiming interest upon the belated payment and also unpaid last 11 days salary vide their representations dated 05.12.2024 and 11.12.2024. Since the same were not considered by the respondent, the present Writ Petition has been filed.

Though, the learned Standing Counsel for the respondent objects claim for last 11 days salary and she would fairly concede that in view of the similar orders passed by this Court in W.P.Nos.40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum on the delayed payment of the eligible and admissible amount.

4. Heard the learned counsel for both sides and perused the materials available on record.

In such view of the matter, this Court deems it appropriate to direct the respondent to pay the interest at the rate of 6% per annum upon the delayed payment of the retirement benefits, from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioner. However, in respect of the last 11 days salary, the respondent is directed to consider the petitioners' representation dated 05.12.2024 and 11.12.2024 and pass orders on its own merits and in accordance law, within a period of six weeks from the date of receipt of copy of this order.

6. With the above direction, the Writ Petition is disposed of.
