Crl.M.P.No.9299 of 2016 in Crl.R.C.No.937 of 2016 G.CHOCKALINGAM, J This Court passed a conditional order dated 03.08.2016 in Crl.M.P.No.7278 of 2016 in Crl.R.C.No.937 of 2016 directing the petitioner to deposit 50% of the cheque amount to the credit of STC.No.262 of 2012 on the file of the learned Judicial Magistrate, Fast Track Court No.II, Erode on or before 17.08.2016. Since the petitioner was not able to comply with the said condition, he filed Crl.M.P.No.9299 of 2016 seeking extention of time to comply with the conditional order dated 03.08.2016. This Court after considering the reasons stated in the affidavit filed in support of the petition, granted time till 07.09.2016, failing which, the order dated 03.08.2016 shall stand dismissed automatically without further reference to this Court and the said petition was directed to be listed on 08.09.2016 "for compliance".

2.Today, when the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the petitioner is not able to comply with the condition and hence, he seeks extension of time to comply with the conditional order dated 03.08.2016. Even though this Court

cla granted sufficient time to comply with the conditional order, the petitioner has not complied with the same.

3.In view of non compliance of the conditional order dated 03.08.2016, the Criminal Miscellaneous Petition is dismissed. 08.09.2016 cla Crl.M.P.No.9299 of 2016 in Crl.R.C.No.937 of 2016
