This petition is filed to condone the delay of 138 days in filing the second appeal against the decree and Judgment passed in A.S.No.38 of 2023 dated 12.09.2023.

2.The petitioner states that she is a senior citizen aged about 67 years and because of her health issues like heart ailment as well as diabetic problem, she could not file the appeal in time.

3.I am satisfied with the reasons given by the petitioner and so the delay of 138 days is condoned.

4.Accordingly, this petition is ordered.

5.Registry is directed to number the petition, if it is otherwise in order.
