O R D E R

The present Writ Petition has been filed for the issuance of a Writ of Mandamus to direct the respondent to dispose of the petitioner's representation dated 13.06.2013 submitted to the respondent.

2. The learned counsel for the petitioner submits that the petitioner availed a loan for a sum of Rs.5,84,000/- from the respondent Bank for purchasing Tractor (agricultural) along with LMV Trailer. The petitioner has paid some amount to the credit of the loan account. Thereafter, the Government has introduced waiver scheme to the small farmers. As the petitioner is one of the small farmers, he made a representation dated 13.06.2013 to the respondent Bank for waiver of the loan. But, the respondent, without disposing of the petitioner's representation, had issued a legal notice on 16.08.2013 threatening to take coercive action, for which, the petitioner has replied on 24.08.2013. Again, the respondent has called the petitioner to repay the loan forthwith ignoring his representation to waive the loan. Aggrieved over the same, the petitioner has come before this Court by way of the present Writ Petition.

3. Heard the learned counsel appearing for the petitioner and the respondent.

Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the representation, directs the respondent Bank, to consider the petitioner's representation dated 13.06.2013 and pass appropriate orders, on merits and in accordance with law, after issuing notice to the petitioner and the persons interested in this regard and also affording them an opportunity of personal hearing, within a period of eight (8) weeks from the date of receipt of a copy of this order.
