J U D G M E N T

(Judgment of the Court was delivered by R.SURESH KUMAR, J.) When the writ appeal is taken up for hearing today, Mr.D.Vijayakumar, learned counsel for the appellants submits that the retirement benefits sought for, which is the issue raised in this appeal, has already been settled to the employee and therefore, nothing survives in this appeal. The said statement made by the learned counsel for the appellants is not controverted by the learned counsel for the respondent also.

2. In view of the said submission, the writ appeal is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is also dismissed.
