C.M.P.No.26336 of 2023 in C.M.A.Sr.No.84061 of 2023 N.ANAND VENKATESH , J Pursuant to the earlier order passed on 04.06.2024, learned counsel for appellant has taken notice to the learned counsel, who appeared for the first respondent before the Tribunal and an affidavit of service has been filed. However, there is no representation for the first respondent either in person or through a counsel.

2. This Civil Miscellaneous petition has been filed seeking to condone the delay of 299 days in filing the Civil Miscellaneous Appeal.

3. Heard the learned counsel for the appellant and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 299 days in filing the above appeal is condoned.

Registry is directed to number the main Civil miscellaneous appeal, if it is otherwise in order and list the same for admission in due course.
