This Criminal Original Petition has been filed by the petitioner/A2, who was arrested and remanded to judicial custody on 28.05.2024, seeking bail in Crime No.199 of 2024 registered for the offence under Section 392 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner aged about 21 years, is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner, who is no way connected with the alleged offence, has been suffering incarceration from 28.05.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that, the petitioner/A2 along with A1, who came in a two wheeler, had snatched the hand bag of the de facto complainant which contains a cash of Rs.3000/-, three ATM cards mobile and house key, and escaped. He further submitted that the case is under investigation and the petitioner is having four previous cases. Therefore, if he is released on bail, there is every possibility of him absconding and threaten the witnesses.

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the fact that the investigation is at initial stage and also considering the antecedents of the petitioner/A2, this Court is not inclined to grant bail to the petitioner.
