Petition filed under Article 226 of the Constitution of India for issuing a writ of mandamus directing the respondents 1 & 2 to accept documents of Deed of Revocation that was executed by the petitioner dated 18.02.2016 to revoke and annul the sale deed dated 11.10.2000 registered as Document No.2053 of 2000 executed to and in favour of Amudha wife of Kuppan and daughter of V.G.Mani, in view of the fact that the above Amudha died on 17.04.1998 itself.

The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the respondents 1 & 2 to accept the documents of Deed of Revocation that was executed by the petitioner on 18.02.2016 to revoke and annul the Sale Deed dated 11.10.2000 registered as Document No.2053 of 2000 executed to and in favour of Amudha wife of Kuppan and daughter of V.G.Mani, in view of the fact that the said Amudha died on 17.04.1998 itself.

2.Mr.B.Kannan, learned Government Advocate appearing for the respondents submitted that since the petitioner is seeking to cancel the Sale Deed dated 11.10.2000, the remedy open to the https://hcservices.ecourts.gov.in/hcservices/

petitioner is only to file a Civil Suit before a Competent Civil Forum.

3.I fully agree with the submission made by the learned Government Advocate and I am of the considered view that the remedy open to the petitioner to get the Sale Deed dated 11.10.2000 cancelled is only before a Competent Civil Forum. In such view of the matter, I am not inclined to entertain the Writ Petition. Accordingly, the Writ Petition is dismissed. No costs.
