Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to reinstate the petitioner in the service of the Vanagaram Panchayat Office with all monetary and attendant benefits based on the petitioner's representation dated 19.05.2021.

ORDER

Mr.L.S.M.Hasan Fizal, learned Government Advocate takes notice on behalf of the first to third respondents.

2. It is the case of the petitioner that the petitioner was appointed on daily wage basis as a Sweeper/Sanitary Worker with the third respondent Vanagaram Village Panchayat. However the fourth respondent as the President of the Vanagaram Village Panchayat, took an unilateral decision to discharge the petitioner from service, as a result of which, the petitioner is out of employment since 06.06.2020. In this connection, the petitioner has sent several representations.

3. The Deputy Block Development Officer has also sent a communication to the office of the second respondent and that the second respondent has also sent letters to third respondents to take steps.

4. Considering the plight of the petitioner, this Court is inclined to dispose this writ petition at the time of admission by directing the third respondent to take steps to reinstate the petitioner at Vanagaram Panchayat Office as was the position prior to 06.06.2020. Such exercise shall be carried out by the third respondent within a period of eight weeks from the date of receipt of a copy of this order.

5. This Writ Petitions stands disposed of with the above observations.

No costs.
