(Order of the Court was made by N.Kirubakaran, J) This is a petition to condone the delay of 40 days in filing the above appeal.

2.Even thought the Insurance company has been served and name also printed in the cause list, no one entered appearance on behalf of the Insurance Company.

3.Having been satisfied with the reasons stated in the affidavit filed in support of the above petition and after hearing the learned counsel appearing on the side of the petitioner, the delay is condoned and the petition is ordered as prayed for.
