This application has been filed to condone the delay of 355 days in paying the deficit Court fee while filing the written statement and counter claim in C.S.No.521 of 2018.

2. The one and only objection raised by the learned counsel for the respondents / plaintiffs is that this application is combined with other reliefs of filing written statement along with counter claim without taking out a separate application to condone the delay, if any, in filing the same.

3. However the learned counsel for the applicants / defendants submitted that unless the delay in paying deficit Court fee is condoned, the application filed to condone the delay in filing the written statement will not be numbered.

4. Taking into consideration of the submissions of the learned counsels on both sides, the delay in paying the deficit Court fee alone is condoned.

5. Registry is directed to number the application, if any, filed to condone the delay in filing the written statement, if it is otherwise in order, and list it on 29.08.2023.
