Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents to consider petitioner's representation dated 23.06.2018 for surveying the land in the layout named as 'Sasthri Nagar' bearing Plot Nos.16 and 17 comprised in Survey No.18/6, Patta No.1080, as per patta, Survey number is 18/6B measuring 4080 and Plot Nos.60 measuring 1800 sq.ft., and 60A measuring 300 sq.ft., comprised in Survey No.18/9, as per Patta No.2193, Survey No.18/9A2, 18/9B2 of No.13, Vellanoor Village, Ambattur Taluk, Tiruvallur District, within the time that may be fixed by this Hon'ble Court.

ORDER

The petitioner, claiming to be the absolute owner of the land in the layout named as 'Sasthri Nagar' bearing Plot Nos.16 and 17 comprised in Survey No.18/6, Patta No.1080, as per patta, Survey number is 18/6B measuring 4080 and Plot Nos.60 measuring 1800 sq.ft., and 60A measuring 300 sq.ft., comprised in Survey No.18/9, as per Patta No.2193, Survey Nos.18/9A2, 18/9B2 of No.13, Vellanoor Village, Ambattur Taluk, Tiruvallur District under a deed of settlement dated 21.11.2013 executed by her mother Mrs.Mary Chackochan, W/o late Mr.P.V.Chackochan in respect of the aforementioned property, has given a representation on 23.6.2018 to the third respondent to survey and measure the property comprised in Survey Nos.18/9A2 and 18/9B2 as per the Patta No.2193 issued in favour of her father. As the said representation has not been considered, she has come to this Court.

2. Mr.S.N.Parthasarathy, learned Government Advocate for the respondents 1 to 3 submitted that if the petitioner furnishes the copy of the previous representation along with the copies of patta, settlement deed and other documents, her request will be considered.

This Court hereby directs the petitioner to furnish a copy of the previous representation along with the copies of the patta, settlement deed and other documents in respect of the property comprised in Survey Nos.18/9A2 and 18/9B2 as per the Patta No.2193 to the third respondent-Tahsildar, Avadi within a week from the date of receipt of a copy of this order. On receipt of the same, the third respondent, after giving notice to the fourth respondent, shall appoint a land surveyor to survey and measure the property in question and do the needful within a period of four weeks therefrom. The writ petition stands disposed of accordingly. No costs.
