Learned counsel has also made an endorsement to that effect in the Court bundle.

2. Recording the said endorsement, A.No.5128 of 2024 in C.S.(Comm.Div) No.187 of 2024 is dismissed as not pressed.

Liberty as sought for by the applicant/ plaintiff is granted.

3. Learned counsel for applicant/ plaintiff submits that an application seeking leave to defend has been filed by the defendant. However, as seen from the report submitted by the Registry, the said application has been returned for certain compliance on 29.11.2024. Learned counsel for defendant seeks time to represent the said application. Registry is directed to number the said application once it is re-presented, if the same is otherwise in order and list the same for hearing on the next hearing date.
