Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the first and second respondents to dispose of petitioner's representation dated 03.12.2012 to the first respondent and subsequently on 23.02.2013, 29.08.2013 and 10.09.2013 to second respondent requesting them to conduct a thorough investigation into the acts of HDFC Bank Ltd., the third respondent herein set out by the petitioner in his representations. ORDER

This writ petition has been filed by the petitioner as one of the customer of the 3rd respondent/Bank. The petitioner has filed this writ petition for a mandamus to direct the 1st respondent/General manager and 2nd respondent/Department of Banking Supervision, Reserve Bank of India to consider and dispose the petitioner's representations dated 03.12.2012, 23.02.2013, 29.08.2013 and 10.09.2013 to investigate into the affairs/acts of the 3rd respondent.

2.In my view, this writ petition is not maintainable. The petitioner has an alternate remedy to approach the Banking Ombudsman under the provisions of the RBI Act/Banking Regulation Act. That apart, the petitioner has filed this writ petition as a public spirited person though appears to have grievance with the third respondent. Therefore, I am inclined to dismiss this writ petition. However, liberty is given to the petitioner to file an appropriate application before the Banking Ombudsman to redress his grievance, if any, within a period of 30 days from the date of receipt of a copy of this order. 3.This writ petition stands dismissed with the above observations. No costs.
