ORDER
(Order of the Court was made by P.VELMURUGAN,J.) The present petition is filed to condone the delay of 1657 days in filing the above appeal.
2.The learned counsel for the appellant would submit that the appellant never entered into the sale agreement and he never executed any power of attorney. Since the appellant was not aware of the suit filed, there was a delay of 1657 days in filing the present appeal.
3.On the other hand, the learned counsel for the 1st respondent would submit that the 1st respondent entered into an agreement with the power agent of the petitioner. However, inspite of being aware of conditions in the agreement, the power agent was not able to vacate the tenant. Thus, the petitioner was well aware of the suit being filed by the 1st respondent. 4.Though the 1st respondent has stated that based on the power of attorney, the power agent had entered into the agreement, neither the 1st
respondent produced the power of attorney along with the plaint at the time of filing the suit nor marked the documents during the trial. Therefore, by taking note of the reasons adduced in the affidavit filed in support of this miscellaneous petition, this Court is inclined to condone the delay. 5.Accordingly, the delay of 1657 days in filing the aforesaid appeal is condoned and the Civil Miscellaneous Petition stands ordered.
