ORDER

(Order of the Court was made by The Hon'ble Chief Justice) We have heard Mr.S.Sathia Chandran, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader, for respondents 1 to 3.

2. The writ petition is filed in the nature of public interest. It is submitted that as per tender and the work order, the contractor has not carried out the work.

3. The petitioner has given representation to the District Collector. The work order, it appears, is issued by the Block Development Officer, Panchayat Union, Nemili. In case the contractor fails to carry out the work as per the tender and work order, then the authority is competent to take further steps as per the terms and conditions of the tender. There is nothing on record to show that

amount has been paid to the contractor. We are not aware of the reasons for non-execution of the work or otherwise, as per the work order. If the work is not being conducted in tune with the work order, then the authority is entitled to proceed as per the terms and conditions of the tender and take appropriate steps.

4. With these observations, the writ petition is disposed of. There will be no order as to costs.
