The petitioner who was arrested and remanded to judicial custody on 23.03.2023 originally registered for the offence under Section 326(A) IPC and subsequently altered to Section 302 of IPC in Crime No.151 of 2023 on the file of the respondent Police, seeks bail. 2.It is alleged that he is an accused in two calender cases. He had come over to Judicial Magistrate No.I, Coimbatore, to attend those two calender cases. The petitioner, who was the husband of the deceased, received acid from his parents and thrown that on her face, chest and front portion of her body. Thereafter, she was admitted in the hospital for 30 days and unfortunately, she died.
3.Originally, the First Information Report was registered under Section 326(A) of IPC and subsequently, altered to 302 of IPC.
4. It is also stated that the accused Nos.2 and 3 who are the parents of the petitioner are still absconding and they had handed over the acid to the petitioner herein.
5.The charge sheet has been filed also showing that they are absconding. The case can never be committed so long as A2 and A3 are absconding.
6.The learned counsel for the petitioner states that the petitioner is in custody for a considerable period of time and that an young infant has to be taken care of.
